Used Jetta OBD Failed

I just bought a used VW Jetta without a warranty. My bad. I go to get
a state inspection and the dealer tells me the OBD system isn't
responding. Maybe he can fix it, maybe he can't. My question is if he
can't fix it, does anyone know if New York State has any leeway to
allow tailpipe testing for emissions to qualify in lieu of the OBD. Or
do I have to throw the car away.

Despite the car being sold with no warranty, most states have requirements
pertaining to the car's emissions or safety compliance (illegal to sell a
car that won't pass). I don't know if NY is one of these states, but if it
is, that's probably the best line of recourse against the seller. You may
also want to try a different inspection station; it's possible the fault
lies with the tech and not with the car.
