Let me help you...

Emerging legal issues.

Hyundai sued for wrongful death
The West Virginia Record reports that John Borders, a father from
Kopperston, WV, has filed suit individually and on behalf of his
daughter?s estate against Hyundai Motor Co., Hyundai Motor America,
Mountaineer Hyundai and Autoliv Australia

Borders blames the car makers for the death of his 24-year-old
daughter, Kimberly Dawn Borders who died after she was ejected from her
Hyundai after an accident on August 15th, 2006.

He charges that the 2003 Hyundai Tiburon?s Autoliv restraint system
failed when his daughter?s car slid into a concrete water drain
installed in the median, causing it to flip over.

"During the crash, as the vehicle overturned, the seatbelt disengaged,"
the complaint says. "As the Hyundai Tiburon finally came to rest in the
median, the plaintiff's decedent was partially ejected from the
driver's side window."

Kimberly Dawn Borders was pronounced dead on the scene.

The Hyundai Tiburon has been at the center of a lot of controversy -
including a class action lawsuit.

Oh my - someone might actually die in a car accident?

Where is Judy to demand that all auto-makers be executed since they must
be murderers in her eyes.

Actually, the article says the seat belt failed.

Yes, an article written by the same lawyers who are filing the class
action suit.

from the site that posted the story:

"OLM's principle activity is researching and producing a news digest
available on the internet. This is done both as a public service and as
a business...OLM has no lawyers on staff, nor is it owned by, or
associated with, any law firm."
