Traffic Ticket in Toronto
Hi folks,
Just received a ticket over the weekend for failing to stop (a rolling stop) at a stop sign. Will be pleading not guilty and fighting the ticket in traffic court. Question, has anyone ever used X-Copper as a service? Is it worth the $300 CDN? Any idea if this is a charge that is easily fought, short of the officer not showing up? TIA, HDR |

Unless you are in danger of losing your licence, have a strong case to make
in your defence, expect the cop to fail to show, or have found a technicality that will obviate the ticket (I once had one dismissed because the cop forgot to write in the city where the offence took place), why bother? The fee for the service sounds like it's about triple what a fine might be, and you'll probably have to pay both. I would hesitate to pay $300 (even $C) for such a service, but just showing up on your court day will only cost your time, lost wages and gas money to the couthouse. If the copper doesn't show, you win. If he does show (and you have no defense) you can always plead guilty at that time and pay the fine. -Fred W |

I knew that more likely than not, the cop will turn up (Kitchener just isn't as busy) and decided to see a JP (justice of the peace, a 24 hr service)instead. Pleaded my case that I am guilty but that I am a responsible driver etc. and had my fine reduced to something like $25.00. You may want to try that. If you do decide, the JP is adressed as 'your worship'! Regards, Vijay |

I said please stop and give me the ticket thanks. (-; But seriously, it's not a subjective call. In the end it will be your word against the cops so you've got a 50/50 chance AT BEST. Your only argument could be that you did stop, but perhaps the officer didn't perceive this because you were stopped for just a second, (or maybe he was in a moving car?). Don't be a wise guy, be very nice and polite and say stuff like you can understand how the office MIGHT have thought that you didn't stop, but he was mistaken. Then you'll be at the 50/50 chance. Any suggestions that the cop was just plain wrong or an asshole, etc. etc. will kill any chance of success. IF you have an excellent record bring that up, otherwise stay away from it. Good luck. The X-Coppers type guys are best for speeding tickets, because they know what questions to ask to cast aspersions on the accuracy of the speed you were tagged for. This bit I know from excellent sources, but as for anything else I'm not sure. If it's free to talk to them about your situation then why not go and see how you feel? Let us know how it turns out. I was advised by a cop who gave me a speeding ticket (I'm known to the police as a good guy, but I didn't know this cop), to just show up for the court date and talk to him before and remind him about it. When I showed up and did he said he would agree to a lesser speed with no points and told me to go over to Crown or prosecutor and tell him that, and that's what happened when I got called. I guess he just wasn't willing to let me walk, but was nice enough to give me a break. When I asked him later what that was all about he said that he doesn't give guys a break at ticket time because he's given guys major breaks and then the prick still goes to court to fight it, even bringing up that the cop gave him a break so "he must have jacked up the speed" or some bull**** like that. Also insurance doesn't care if it's points or no points within reason, they just call it a "minor infraction". To that end I had "failing to product proof of insurance" and a ticket for 15 over or whatver it was, = 3 points, weighed equally as "two minor infractions" to bump my insurance up. -Russ. |
