Need Help for my case!!!!!!
Two weeks ago I was driving alongside the parking lot of a mall. A
police officer caught me because I ran a stop sign there. He said "pull over in the parking lot". It was my first time get caught, so I turned my car right away and pulled it over. Then the police officer gave me two citations for the reason that I ran the other stop sign when I turned my car to the parking lot. I'm going to ask for traffic school for the first ticket. Do you think I can contest and beat the second ticket which I got at the same time as the first one? If so, what would be appropriate to say to the judge? I really got ****ed off. I will sincerely appreciate any help! Thanks!!! |

Other than that, you can always try going to: http://www.state.xx.us (change xx to your state postal abbreviation). Look up the law you were charged with violating, and then try finding court rules pertaining to your type of court case. Perhaps you can find something there that may help. |

Argue you were following the officer's instructions on the second. A police officer's instructions trump traffic control devices. If the officer says he didn't intend for you to do that, just state the truth that you were doing what you thought he wanted. |

AFAIK, the stop signs at malls and other private property are not put up by the city, so I dont think that traffic cops have any right to enforce them. PS: very typical of an asshole cop to cite you TWICE. |

Not sure of the specific situation there but here if a road is open for public use, such as a car park, then it is still subject to the road traffic act and you can be prosecuted for driving offences. IMO going through a second stop sign while you are being watched by police is just careless! |

You need to be aware that traffic control devices (such as stop signs, speed limit signs, etc.) in mall parking lots are NOT enforceable. The mall is 'private' property. The mall parking lot is not a public road. Cops can only cite you for traffic infractions that happen on public roads. Pull up a map of your city, and see if you were even ON a public road when you were cited. If not, then the tickets are not valid. You can easily get the charges dismissed by simply showing the judge that you weren't on a public road at the time. If the judge doesn't agree, appeal to a higher judge. Eventually, you will find one that will enforce the law as it is written. But assuming that both stop signs you ran were on a public road, the second ticket should be tossed anyway. It was entrapment. The officer told you where to go. If you had NOT gone there, you would have been cited for failure to obey the order of a traffic cop. (or, more likely, ARRESTED) But because you did what you WERE LEGALLY OBLIGATED TO DO, as ordered by the traffic cop, you were cited for running another stop sign. Thus, it was entrapment, and you should argue it as such. Nothing you can do about the 1st ticket, though. -Dave |
